By accessing or using our Services, you confirm the execution of a binding contract with CRUWI, accepting these Terms and agreeing to their mandatory compliance. This platform and the services related to it are offered to Users who have the legal capacity to enter into legally binding contracts according to applicable legislation.
You declare that you know and accept all the risks involved in this economic activity and its possible consequences, and you voluntarily and freely assume full responsibility for all risks and dangers involved in the activity, committing to provide CRUWI with accurate, complete and updated registration information about yourself, including the required personal data.
You will not share your CRUWI user ID, account or password with anyone, and you must protect the security of your CRUWI user ID, account, password and any other CRUWI access tool or credential. You are responsible for any activity associated with your CRUWI user ID and account.
It is important that you maintain and immediately update your information and any other information you provide to us, in order to keep all information updated and complete.
By signing these terms and conditions, you accept that you are solely responsible for any activity that occurs in your account.
Minors are not authorized to use the CRUWI platform. If you are a minor, please do not use this platform.

You declare and guarantee that you are a person of legal age to enter into a binding contract. If you accept these conditions on behalf of an organization or entity, you declare and guarantee that you are authorized to accept these conditions on behalf of such organization or entity and bind them to these conditions (in which case, references to "you" and "your" in these conditions, except in this sentence, refer to such organization or entity).
You will only use the services for your own internal, personal and non-commercial use, and not on behalf of or for the benefit of third parties, and only in a manner that complies with all applicable laws. If your use of the services is prohibited by applicable laws, then you are not authorized to use the services. We cannot and will not be responsible for your use of the services in a manner that violates the law.
You will not share your CRUWI user ID, account or password with anyone, and you must protect the security of your CRUWI user ID, account, password and any other CRUWI access tool or credential. You are responsible for any activity associated with your CRUWI user ID and account.
Concepts
For the CRUWI team, it is essential that you know and understand some basic terminology that we will use in our legal texts:
- Personal account: space accessed by CREATORS where they can access their personal information as a CRUWI user at https://creators.cruwi.com
- Content creators or CREATORS: are the platform users who register on CRUWI in order to collaborate with brands through it.
- Challenge: is how we refer to collaborations between Brands and CREATORS.
- Reward: the price that brands pay to CREATORS for a collaboration made in accordance with the established rules.
- Services: set of services offered by the Website and/or platform either directly through it or by information.
- Website: internet site accessible at the address https://www.cruwi.com/creators-conditions
- Owner: person (natural or legal) owner or responsible for the Website
- User: any person who browses the website and has not registered.
General Terms of Use
Link policies of this website
Both this website and its platform may contain links to other websites or mention other websites, for which the owners of the same will be responsible. CRUWI is in no way responsible for problems or violations of rights that websites owned by third parties may pose to the user, please read their Legal Notices.
CRUWI does not recommend, promote or identify with, nor guarantee, represent, sponsor, or endorse any linked website or owned by third parties that may be commercially named on the platform. CRUWI only hosts the advertisements that other brands advertise, without this implying that CRUWI knows the contents and services of the linked sites or third parties that appear on our website or platform and, therefore, is not directly or indirectly responsible for any damage of any kind caused by the content and/or services of the linked Websites nor for any other damage that is not directly attributable to the website https://www.cruwi.com or its platform.
CRUWI is not responsible for the content to which the links or hyperlinks of content creators redirect in execution of the collaboration agreed with a brand through CRUWI. The CREATOR agrees to hold CRUWI harmless from any liability to third parties that may arise from the content of such links or hyperlinks.

Intellectual and industrial property
https://www.cruwi.com, its integrated platform, the pages it comprises and the information or elements contained therein, hereinafter the CONTENT, are protected by intellectual or industrial property rights, of which CRUWI is the owner and/or holds a license or express authorization for its use and public communication by the legitimate third-party owners of the same for their inclusion on this website.
Specifically, the CREATOR is not authorized to proceed with the reproduction, total or partial reinterpretation, use, exploitation, distribution, alteration, dissemination, sale, for commercial purposes of the contents of this website or its platform without the prior express authorization of CRUWI.
Any unauthorized use will be considered a serious breach of intellectual or industrial property rights, and compensation may be claimed in this regard.
These Terms and Conditions are part of our intellectual property. Their use by third parties is not permitted, either in whole or in part, with the commercial intention of offering products or services. Non-compliance with such prohibition is subject to legal action.
Errors in content
At CRUWI we make every possible effort to provide truthful, adequate and updated information, despite this, there may be some typographical error, beyond the will of CRUWI. In this case we will correct it at the moment we detect it. If it is the user or client who detects the error, please notify us at hello@cruwi.com.
However, and in compliance with the provisions of articles 11 and 16 of the LSSI-CE, CRUWI makes itself available to all users, authorities and security forces, to actively collaborate in the removal, or where appropriate blocking, of all those contents that could affect or contravene national or international legislation, third-party rights or morality and public order.

Basic Conditions for Creators
Personal account
Creation of the personal account
The User who wishes to make use of the services offered on the Website and its platform for CREATORS, must create a personal Account as a CREATOR through the form provided for this purpose, for which they will have to follow the indicated instructions and provide the required data.
During the account creation process, the CREATOR must choose a name and a password that will allow them to access it.
The CREATOR will be solely responsible for selecting a password with an adequate level of security. To this end, it is recommended not to choose obvious combinations as a password that allow its easy decryption by a third party. The CREATOR will be responsible for keeping and maintaining secrecy regarding their password, and must not provide it to a third party. In the event that they suspect that their password has been known by a third party, they must immediately proceed to modify it.
To be able to participate in challenges, the CREATOR must have their CRUWI profile linked to their TikTok and/or Instagram profile. Through this legal text, the CREATOR declares to be fully aware that for the correct functioning of CRUWI the CREATOR must have a personal account on the TikTok and/or Instagram Social Network, and that they accept making use of TikTok or Instagram services, as well as their terms and conditions and their privacy policy.
The CREATOR expressly accepts to hold CRUWI harmless from any liability to any person, that may arise from the use of TikTok or Instagram services, as well as from the acceptance of their terms and conditions and their privacy policy.
The CREATOR guarantees that all data they provide to CRUWI when creating their personal Account is truthful and actually corresponds to their data, and must notify CRUWI of any subsequent change or modification.
By creating a user Account, the CREATOR expressly and without reservation accepts these Terms of Use.
The User agrees that they will use this Website and its platform in accordance with current legislation and as established in these Terms of Use.
Types of accounts allowed on the platform
It is important to read this section so as not to be disappointed with the platform or have false expectations.
Any creator with more than 500 followers on TikTok and 10 videos published or 1000 followers on Instagram and 5 published contents can potentially be a creator on CRUWI. That said, not all accounts that meet those basic requirements are accepted by CRUWI as content creators. The profiles that creators connect, that is, their TikTok and/or Instagram must meet the basic requirements mentioned and the following requirements to be able to participate on the platform and access challenges:
- The creator's profile must be publicly accessible. No creator can participate in CRUWI with a private profile. If the account type change occurs once they have participated in a challenge, the platform reserves the right to reject the content canceling, if applicable, the rewards.
- Creators with the following content categories are not allowed: pornography, sexual content, tobacco, alcohol, terrorism, crime and other sensitive topics.
- Business accounts are not allowed, except for exceptions managed by the team manually.
- Accounts for re-uploading clips or reposts from other accounts are not allowed.
- Accounts whose content is based on uploading videos where there is no human presence (videos with phrases and music, reflection galleries, motivational phrases, etc.) are not allowed
- Accounts that have purchased followers or have altered any of the metrics inorganically are not allowed.
In summary, accounts must be personal and real.
Deletion of the personal account
The CREATOR can delete their personal Account at any time from their profile, through the "other actions" tab > "delete account".
Make sure to claim the available withdrawable balance before deleting your account, as once deleted, the amount accumulated up to that moment will be lost. Likewise, when deleting the personal account, all information stored in the CREATOR's profile will be automatically lost.

Fraudulent use of the personal Account will result in the loss of the right to continue using the services of the website and its platform, and the possible claim for damages caused by it. CRUWI reserves the right to deregister CREATORS who repeatedly present content that does not meet the requirements indicated by the brand, that are of low quality or present offensive, illegal or contrary to CRUWI policy content.
Challenges
The objective of CRUWI is to connect major brands with CREATORS registered on the platform to carry out promotional content collaborations through challenges.
Brands publish challenges on the CRUWI platform, which are available to all users registered as CREATORS, detailing their conditions and attaching an exemplary video. Not all CREATORS will be able to participate in all challenges, as there are certain requirements that the creator must meet (age, type of content, gender, etc.) that are established by the brands. These will indicate in the challenge descriptions and in other sections both the characteristics that the videos must have, as well as the economic conditions. CRUWI will publish the challenge conditions on the platform and in other channels of interest to creators (these conditions may be subject to changes).
If the CREATOR is interested in the challenge, they must click on the "participate" tab, accepting the conditions established by the brand for that challenge. Participation in the challenge does not guarantee the reward, on the contrary, the creator's material must be previously validated by the brand for the CREATOR to obtain the corresponding amount.
Challenges have limited places. That is, in each challenge only a limited number of CREATORS can participate, whose content will be evaluated in order of submission to the brand. Challenges are time-limited, read the conditions of each challenge carefully.
The content that CREATORS deliver to brands when participating in their challenges must be completely original and made exclusively for the advertiser. The content cannot be used by the CREATOR for a different third party or for purposes other than those expressly indicated by the collaborating brand. Non-compliance may result in the deletion of the CREATOR's account and the retention of the existing balance.
The content must remain on the CREATOR's TikTok or Instagram profile for the time agreed with the brand. Non-compliance with this condition authorizes CRUWI to delete the CREATOR's account on its website and integrated platform, as well as to retain the available balance.
Obtaining and withdrawal of rewards
Rewards
We strongly recommend consulting the challenge conditions before accepting to participate.
All challenges involve a fixed reward, which is obtained after the video is validated by the brand; and a variable reward, depending on the views of this in a given time. Both are unilaterally set by the brands.
Rewards can also be obtained by inviting friends. Before using it, carefully read the conditions of the invitation system available on the website.
Restrictions and penalties
You declare, guarantee and accept that you will not use or otherwise interact with the services offered by CRUWI, in a way that:
1. Infringes or violates intellectual property rights or any other right of any other person (including CRUWI as a brand).
2. Infringes any law or regulation, including, among others, applicable export control laws, privacy laws or any other purpose not reasonably foreseen by CRUWI.
3. Is dangerous, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene or objectionable for any other reason (which includes, among others, the use of profanity, the use of music with profanity and any sexual, violent or explicit content).
4. Endangers the security of your CRUWI user ID, your account or that of any other person (such as allowing another person to log into the services as you).
5. Attempts, in any way, to obtain the password, account or other security information of any other user.
6. Violates the security of any computer network, or decrypts any password or security encryption code.
7. Executes Maillist, Listserv, any form of auto-response or "spam" on the services, or any process that runs or activates while you are not connected to the services, or that interferes in any other way with the proper functioning of the services (including placing an unreasonable load on the services infrastructure).
8. "Tracks", "scrapes" or "scratches" any page, data or part of the services or content or related to them (by using manual or automated means such as scrapping, bots..)
9. Copies or stores any significant part of the content.
10. Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information from or related to the services.
11. Manipulates TikTok or Instagram functions and other platforms to promote content created for CRUWI, which includes purchasing views, engagement, followers or using automated software or, in some way, manipulating their social media metrics to receive additional payments from brands. Only views achieved organically will be valid.
Payment method
We use an external payment processor to pay you through a payment account linked to your account on the CRUWI platform (section: "my balance"). Payment processing will be subject to the terms, conditions and privacy policies of the payment processor, in addition to these conditions. Currently, we use Stripe and Shopify as our payment processors. We are not responsible for errors or other acts or omissions of the payment processor. We reserve the right to correct any error or mistake made by the payment processor even if you have already requested or received payment.
Important: you must provide updated, complete and accurate information about your billing account to receive payment. You must update without delay all information to keep your billing account updated, complete and accurate (such as a change in billing address, credit card number or credit card expiration date), and you must notify us without delay to us or our payment processor if your payment method is canceled (for example, due to loss or theft) or if you become aware of a possible security breach, such as unauthorized disclosure or use of your username or password. Changes to such information can be made in the account settings.
In accordance with Law 35/2006, of November 28, on Personal Income Tax and partial modification of the laws on Corporate Tax, on Non-Resident Income and on Wealth, CRUWI will proceed to apply the corresponding 15% withholding on account of Personal Income Tax, to later deposit its amount with the Tax Authority. Likewise, the CREATOR who agrees and signs with CRUWI these terms and conditions, gives their express consent for CRUWI to issue a self-invoice on behalf of the CREATOR for the services performed by them to CRUWI, in cases where a physical invoice is not issued by the CREATOR.
CRUWI is not responsible in any way for the non-compliance with tax obligations that the CREATOR may present.
To be able to withdraw rewards, the CREATOR must provide CRUWI with their personal data (full name, ID number and address) in order to issue the corresponding self-invoice in accordance with what is reflected in the previous paragraph.
To be able to request the amount of rewards, the CREATOR must accumulate a balance greater than €20. Balance withdrawal entails a 20% reduction where there is a payment to CRUWI by the CREATOR of 5% of the amount to be received as management expenses and 15% as withholding.
To be able to receive rewards for the content you upload through CRUWI, it is essential to comply with the following guidelines:
- The TikTok or Instagram account you use to publish the video or content must be public.
- You may not delete, hide or make the content private for at least 30 days after publishing the video.
- The content must be about the product and the brand for which you are creating the post. The product must be clearly visible in the video.
- Make sure to correctly include the hashtags and mentions indicated in the communications.
- Your social networks (including, among others, Instagram, Facebook and TikTok) may not include inappropriate, unethical, disrespectful content or contrary to these terms of service or to the terms of use of your other social media platforms.
Violation of any of the above points is grounds for CRUWI to withhold payment or cancel it.
The maximum amount of rewards that can be obtained for completing a challenge is subject to the maximum budget established by the brand.
Intellectual Property
The CREATOR, through this document which has the nature of a CONTRACT, accepts to be aware and agree that participation in challenges implies the assignment to the collaborating brand of the exploitation rights of the videos sent by the CREATOR and that pass the validation process.
Thus, the collaborating brand is attributed the power to exploit the CREATOR's content to the exclusion of any other person, including the author himself; except, the rights that TikTok or Instagram grant to the CREATOR, individually, for publishing said content on their profile (such as remuneration to the CREATOR's profile for reaching certain views). In any case, the collaborating brand may exploit the CREATOR's content on its own social networks.
The CREATOR acknowledges that they are not bound by any employment relationship or hierarchy with CRUWI or with the brand with which they collaborate, as well as respecting Spanish regulations. The relationship between the CREATOR and CRUWI; as well as between the CREATOR and the collaborating brand, is of a commercial nature and will be governed, first, by the stipulations contained therein, and, in what is not provided for by them, by the provisions of the Commercial Code, Special Laws, commercial uses and customs and, failing that, by what is established in the Civil Code.
The brand agrees to transfer the previously established rewards as consideration for the assignment that the CREATOR makes of the exploitation rights of their videos. Payment will be made through the PayPal platform after the CREATOR requests balance withdrawal
CRUWI respects the intellectual property rights of third parties and expects CREATORS to do the same.
The CREATOR agrees to respect the Intellectual Property rights of CRUWI and third parties. In any case, it is the exclusive responsibility of the CREATOR. CRUWI does not assume any responsibility for the use that the CREATOR makes of third-party content, and reserves the possibility of claiming damages that may arise from non-compliance by the CREATOR.
All CREATOR content must respect copyright or any other right that exists over them, and therefore the owner of the same in each case.
The intellectual property of and all copyrights that derive from the computer application and the look & feel (appearance) of the websitehttps://www.cruwi.com and its platform belong exclusively to CRUWI, who reserves the right to make at any time any modification that, in their judgment, represents an improvement to the website and the service.

Disclaimer
The CREATOR agrees to hold CRUWI harmless from, and against any, all claims, damages and losses, obligations, losses, liabilities, costs or debts, and expenses arising from: (i) inappropriate use of any service offered by CRUWI; (ii) your breach of any provision of these Conditions; (iii) your breach of any right of a third party, which includes, non-exhaustively, any privacy right or intellectual property right; (iv) your breach of any applicable law, rule or regulation; (v) any Content sent through your CREATOR account; (vi) intentional misconduct or (vii) the use and access of any other third party to CRUWI services with a unique username, password or other appropriate security code.
Neither CRUWI nor any company in its group are responsible for damages caused by misuse of the service. The services offered by CRUWI comply with current regulations.
CRUWI will not be responsible and consequently will not be obliged to repair direct or indirect damages or losses that are a consequence of incomplete or incorrect information supplied by members to the intranet of https://www.cruwi.com , nor by the Users' own behavior, nor by insolvency situations that may occur despite the controls that CRUWI has established.
CRUWI will also not be responsible for any damages or losses or loss of business opportunities that may result to CREATORS from the momentary impossibility of accessing the service and especially when such impossibility is a consequence of external circumstances, such as -and without being considered limiting- interruption of communications, electrical services or Internet network failures.
CRUWI will also not be obliged to repair direct or indirect damages or losses that are a consequence of services provided by external companies with which it has reached collaboration agreements and in which CRUWI acts as a mere intermediary.
Every user agrees to defend, indemnify and hold harmless CRUWI, its parents, subsidiaries and affiliates, and each of their respective officers, directors, employees, agents and advisors from all and each of the claims, liabilities, costs and expenses, including, without limitation, attorneys' fees and expenses, arising from a violation of these Terms by you or by any user who uses your account, or arising from a violation of your obligations, representations and warranties under these Terms.
Contract termination
The CREATOR may terminate this contract at any time by deleting their personal account. However, this does not imply the termination of obligations contracted by the CREATOR with third parties through the CRUWI website or platform. That is, the CREATOR must fulfill the challenges in which they are a participant and are incomplete.
CRUWI reserves the right to close its website and the platform integrated therein, giving notice in such case with fifteen (15 days) advance notice, so that CREATORS can request balance withdrawal, without this implying modification of the conditions for such action set forth above.
Privacy Policy and Cookies
CRUWI in compliance with Spanish personal data protection regulations, guarantees full compliance with the obligations described therein, as well as the implementation of the security measures contemplated in the Personal Data Protection Law (Law 3/2018 hereinafter, LOPDGDD) and new European Regulation (EU) 2016/679, hereinafter RGPD.
For more information about the processing of your data, it is important that you read and know the "Data Protection and Privacy Policy" and the "Cookie Policy" of this website. Therefore CRUWI recommends again its reading and understanding and the abstention from using the website or any of its content/services in case of not agreeing with them.
It is necessary for you to know that at CRUWI we collect personal data through contact forms, and the platform integrated into this website. The use of your personal data will be for the provision of the requested services. In case we want to give them a different use to such personal data, your express consent will be requested beforehand.
Although it is necessary for you to accept the "Privacy and Data Protection Policy" in which you are informed in more detail about the use and processing of your data, every user has the possibility to exercise their rights of access, rectification, limitation, portability, cancellation or opposition, through the following email: hello@cruwi.com

Applicable Legislation and Jurisdiction
The relationship between the user and the provider will be governed by the current and applicable regulations in Spanish territory.
If any controversy arises, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction complying with the rules on jurisdiction and competence in this regard.
If ordinary jurisdiction is finally resorted to, the User accepts that claims or complaints against CRUWI that arise from or are related to the use of this website and more specifically with the processing of their personal data will be resolved by the court of competent jurisdiction located in Málaga.
Modifications
CRUWI reserves the right to make the modifications it deems appropriate, without prior notice, to the General Conditions. By accessing you accept to periodically consult the latest version of the General Conditions permanently available on the site.
